1. Service Description

Shahmat Taxi ("the Service") is a passenger transportation coordination system operating between Israeli cities and Eilat/Taba (Egyptian border crossing). The system allows passengers to register for trips and managers to assign passengers to drivers.

The service is operated by Shahmat Taxi.

2. User Obligations

• Provide accurate and up-to-date information during registration
• Hold a valid ticket/pass for the trip
• Be reachable at the provided phone number for coordination
• Arrive at the pickup point at the scheduled time
• Not misuse the system

3. Manager and Driver Roles

System managers are responsible for assigning passengers to drivers. Drivers are responsible for executing the assigned trips. The Service acts as an intermediary between passengers and drivers and does not provide transportation services directly.

4. Service Availability

The Service is provided "as is" (AS IS). We do not guarantee continuous or uninterrupted availability. Downtime may occur due to maintenance, upgrades, or circumstances beyond our control.

5. Limitation of Liability

The Service coordinates transportation only. We are not liable for any direct, indirect, incidental, or consequential damages arising from:

• Trip delays or cancellations
• Conduct of drivers or passengers
• Loss or damage to property
• Temporary system unavailability

6. Cancellation Policy

A passenger may cancel their trip registration at any time before being assigned to a driver. After assignment, the passenger must contact the manager to cancel. Cancelled orders are retained for 90 days and then deleted.

7. Intellectual Property

All rights in the system, including design, code, trademarks, and content, are reserved by Shahmat Taxi. No part of the system may be copied, reproduced, or distributed without prior written consent.

8. Governing Law and Jurisdiction

These terms are governed by the laws of the State of Israel. Exclusive jurisdiction is granted to the competent courts in Israel.

9. Changes to Terms

We reserve the right to update these terms from time to time. Material changes will be published on this website. Continued use of the Service after updates constitutes acceptance of the revised terms.

10. Force Majeure

We shall not be liable for any failure, delay, or inability to fulfill obligations due to circumstances beyond our reasonable control, including but not limited to:

• Natural disasters (earthquakes, floods, storms)
• War, military operations, security emergencies, or terrorism
• Border closures or entry/exit restrictions
• Pandemics, public health emergencies, or government directives
• Strikes, lockdowns, or transportation disruptions
• Failures in telecommunications, electricity, or internet infrastructure

In force majeure circumstances, we will make reasonable efforts to notify affected users and resume the service as soon as possible.

11. Dispute Resolution

In the event of any dispute arising from these terms or the use of the Service:

• The parties shall first attempt to resolve the dispute through good faith negotiation within 30 days of written notice of the dispute
• If the dispute is not resolved through negotiation, it shall be submitted to the competent court in the Be'er Sheva district of Israel

12. Prohibited Uses

When using the Service, you are strictly prohibited from:

• Providing false, misleading, or inaccurate information
• Impersonating another person or using a fictitious identity
• Harassing, threatening, or causing harm to users, drivers, or system staff
• Unauthorized access to the system, other accounts, or data not intended for you
• Scraping user data or automated data extraction
• Attempting to disrupt, damage, or overload system operations
• Using the service for unlawful purposes

Violation of these rules may result in immediate suspension or blocking of your account.

13. Indemnification

You agree to indemnify and hold harmless Shahmat Taxi, its directors, employees, and representatives from any claim, damage, loss, expense, or liability (including reasonable attorney fees) arising from:

• Your breach of these terms of service
• Misuse of the service
• Providing false or misleading information
• Infringement of any third-party rights

14. Severability

If any provision of these terms is found by a competent court to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect. The invalidated provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These terms of service, together with our Privacy Policy and Accessibility Statement, constitute the entire agreement between you and Shahmat Taxi regarding the use of the Service. These terms supersede all prior agreements, understandings, or representations, whether written or oral, relating to this subject matter.
